These Terms of Use ("Terms") form a legally binding agreement between you ("you" or "user") and Moby5 (Pvt) Ltd. ("we," "us," "our," or "the Company"), governing your access to and use of our website at Moby5 and any related services, features, content, or applications (collectively, the "Service"). 

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICE AND MUST DISCONTINUE USE IMMEDIATELY. 

We reserve the right to modify these Terms at any time. We will notify you of changes by updating the "Effective Date" at the top of this page. Your continued use of the Service after such changes constitutes your acceptance of the new Terms. 

The Service is intended for users who are at least 18 years old. Minors are not permitted to use the Service.

We reserve the right to change, modify, or remove content from the Service at any time. We cannot guarantee the Service will be available without interruption. We are not liable for any loss or inconvenience resulting from your inability to access the Service during any downtime. 

10. Governing Law 

These Terms shall be governed by and construed in accordance with the laws of Sri Lanka without regard to its conflict of law principles. 

11. Dispute Resolution 

Informal Negotiations: The parties agree to first attempt to resolve any dispute informally for at least 30 days before initiating formal proceedings. 

Binding Arbitration: If the dispute is not resolved informally, it will be finally settled by binding arbitration. You understand that by agreeing to arbitration, you are waiving your right to a jury trial. 

12. Corrections 

There may be information on the Service that contains typographical errors or inaccuracies. We reserve the right to correct such errors and to update information at any time without prior notice. 

13. Disclaimer 

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. YOU USE THE SERVICE AT YOUR OWN RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 

14. Limitations of Liability 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE OR OUR DIRECTORS AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE PAST SIX MONTHS. 

15. Indemnification 

You agree to defend, indemnify, and hold us harmless from any claims, losses, or expenses (including attorneys' fees) arising from your use of the Service, your breach of these Terms, or your violation of any third-party rights. 

16. User Data 

We will maintain certain data you transmit for the purpose of managing the Service. You are solely responsible for the data you transmit. While we perform routine backups, we are not liable for any loss or corruption of your data. 

17. Electronic Communications 

You consent to receive electronic communications from us. You agree that all agreements, notices, and other communications we provide electronically satisfy any legal requirement that such communication be in writing. 

18. Miscellaneous 

These Terms constitute the entire agreement between you and us. Our failure to exercise any right shall not be deemed a waiver. If any provision is found unenforceable, the remaining provisions will remain in full effect.
