Legal Basis for Processing (For EEA and UK Users)
If you are located in the European Economic Area (EEA) or the United Kingdom (UK), our legal basis for processing your personal information is typically one of the following:
Performance of a Contract: To fulfil our obligations to you under our Terms of Service.
Your Consent: Where you have given us clear consent, for example, for certain marketing communications.
Legitimate Interests: For our legitimate business interests, such as improving our Services, security, and marketing, provided that your fundamental rights do not override those interests.
Legal Compliance: To comply with applicable laws and regulations.
Sharing Your Information
We do not sell your personal information. We may share your information in the following limited circumstances:
With Your Consent: We will share your information when you direct us to.
Service Providers: We engage trusted third-party companies (e.g., for hosting, analytics, payment processing, and customer support) to perform functions on our behalf. They are only allowed to use your information to provide these services.
For Business Transfers: If we are involved in a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred.
For Legal Reasons: To comply with a legal obligation, protect our rights and safety, protect against legal liability, or in connection with a court order.
Data Retention
We will retain your Personal Data only for as long as is necessary to fulfil the purposes set out in this Privacy Policy. We will also retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies.
Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer periods. When we no longer need to use your information, we will either delete it or anonymize it.
International Data Transfers
Your information may be transferred to and processed in countries other than your own, including the United States and Canada, where our servers are located. We take appropriate measures to ensure that your data remains protected in accordance with this Privacy Policy and applicable laws when transferred internationally.
Your information, including Personal Data, may be transferred to and maintained on servers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.
Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer. We will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.
Your Rights and Choices
You have rights regarding your personal information. Depending on your location (for example, if you are in the European Economic Area (EEA) or the United Kingdom (UK)), and subject to certain exceptions, you may have the following rights:

The Right to Erasure (Deletion): You have the right to request the deletion of your personal information under certain circumstances.
The Right to Restrict Processing: You have the right to request that we restrict the processing of your personal information.
The Right to Object to Processing: You have the right to object to our processing of your personal data, particularly where we are relying on a legitimate interest and you believe your fundamental rights and freedoms outweigh our interest.
The Right to Data Portability: You have the right to be provided with a copy of your personal information in a structured, machine-readable, and commonly used format so you can transfer it to another service provider.
The Right to Withdraw Consent: At any time, you have the right to withdraw your consent where Moby5 relied on your consent to process your personal information. This does not affect the lawfulness of processing based on consent before its withdrawal.
To exercise any of these rights, please contact us using the details provided in the "Contact Us" section. We may need to verify your identity before processing your request, which is a security measure to ensure your personal data is not disclosed to someone who does not have the right to receive it.
If you are not satisfied with our response, you have the right to lodge a complaint with the data protection authority in your country of residence.
Additional Information
A. Note for a Merchant's Customers: If you are a customer of a store powered by Moby5 and wish to exercise your rights over your data, please contact the merchant directly. We process such data on behalf of the merchant as a "data processor" and will need to forward your request to them.
B. Data Protection Officer (DPO): While not legally required for our current scope of processing, we have appointed a data privacy led to oversee compliance with data protection laws. You can contact them for any inquiries at the email address in the "Contact Us" section.
C. International Transfers (Safeguards): As outlined in Section 6, we may transfer your data outside the EU/UK. To ensure an adequate level of protection, we rely on approved transfer mechanisms, such as the European Commission's Standard Contractual Clauses (SCCs) or the UK International Data Transfer Agreement/Addendum, with our service providers.
D. Automated Decision-Making: We do not engage in fully automated decision-making, including profiling, that produces legal effects concerning you or similarly significantly affects you.
E. Responding to Data Subject Requests: We commit to responding to your requests to exercise your rights (as listed in Section 8) without undue delay and within one month of receipt. We may extend this period by two further months where necessary, considering the complexity and number of requests. We will inform you of any such extension within one month of receiving your request.
10. Disclosure of Data
We may disclose your Personal Data in the good faith belief that such action is necessary to:
To comply with a legal obligation (e.g., a valid court order or a government agency request)
To protect and defend the rights or property of Moby5
To prevent or investigate possible wrongdoing in connection with the Service
To protect the personal safety of users of the Service or the public
To protect against legal liability
If Moby5 is involved in a merger, acquisition or asset sale, your Personal Data may be transferred, and we will provide notice before your Personal Data is transferred and becomes subject to a different Privacy Policy.
11. Security
We implement robust security measures designed to protect your information from unauthorized access, alteration, disclosure, or destruction. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee its absolute security.
